Owners’ meeting minutes — template under § 24 WEG.

Under German law, the resolutions of an owners’ meeting must be recorded in minutes. Here’s what goes in, who signs and how the resolutions register fits in — with a template to copy.

What belongs in the minutes

§ 24(6) WEG (German Condominium Act) requires minutes of the resolutions. These details make them complete and easy to follow.

  1. Association, date, placeName of the owners’ association, date, place and the start and end time of the meeting.
  2. Chair and minute-takerWho chaired the meeting and who took the minutes.
  3. Attendance and proxiesOwners present and represented, ideally as an attachment listing co-ownership shares or votes.
  4. Notice of meetingA statement that the meeting was properly convened. Since the 2020 WEG reform, a quorum no longer depends on how many owners attend.
  5. For each agenda itemThe exact wording of the motion, the voting result (yes, no, abstention) and the announcement of the result — the resolution only comes into effect once it has been announced.
  6. SignaturesThe chair of the meeting, one unit owner and — if one has been appointed — the chair of the owners’ advisory board or their deputy.

Tips

Minutes that hold up

  • Motions word for word — Settle the wording before the vote and copy it unchanged — challenges often start with imprecise phrasing.
  • Record the announcement — One sentence is enough: “The result was announced.” Without an announcement, no resolution has come into effect.
  • Finish them promptly — Owners need to be able to check the minutes before the one-month period for challenging resolutions runs out.
  • Keep the resolutions register up to date — Announced resolutions must also be entered in the resolutions register without delay (§ 24(7) and (8) WEG).
  • Check the community rules — The association’s community rules (Gemeinschaftsordnung) may set additional requirements for the minutes or signatures.

Questions

Questions and answers

Who has to sign the minutes?

The chair of the meeting, one unit owner and — if an advisory board has been appointed — its chair or their deputy (§ 24(6) WEG).

How soon do the minutes have to be ready?

Without undue delay. Owners should be able to read them before the one-month period for challenging resolutions runs out.

What is the resolutions register?

A running record of all announced resolutions and court decisions concerning the association. The property manager has to keep it and enter new resolutions without delay.

Do I need a full record of the discussion?

No. What’s required is minutes of the resolutions. You can include important contributions if they help people understand them.

Can the owners’ meeting be recorded?

Only with the consent of everyone present. Without it, an audio recording is not allowed. Clarify this at the start and note it in the minutes.
